Campervan Rental Terms & Conditions
These Terms and Conditions define the rental conditions for the MAN TGE 3.140 campervan offered by e-GOLD LAB (Mateusz Pilecki), Tax ID (NIP): 6731896184, based in Szczecinek, Zachodniopomorskie Voivodeship, Poland, operating the website nomadcamper.pl (hereinafter: the “Lessor”). These Terms and Conditions constitute an integral part of the Rental Agreement. Making a reservation is tantamount to full acceptance of the conditions set forth herein.
I. Prerequisites
The Lessee must be at least 21 years of age and hold a valid category “B” driving licence.
II. General Provisions
- These Terms and Conditions define the rental conditions for campervan vehicles and touring equipment included in the Lessor’s offering.
- The Lessor makes these Terms and Conditions available free of charge prior to execution of the Agreement.
- These Terms and Conditions constitute an integral part of the Agreement.
III. Documents and Lessee Requirements
- Execution of the Agreement requires the presentation of two identity documents, including a category B driving licence.
- If an additional Driver is specified in the Agreement, the Lessee shall provide their identifying information.
- A driver authorised by the Lessee is not entitled to operate the Rental Vehicle in the absence of the Lessee. The Lessee bears full liability towards the Lessor for all actions or omissions of the driver, including any losses caused by said driver.
IV. Reservation and Payment Terms
- By making a reservation, the Lessee undertakes to enter into the Agreement on the terms specified in the Agreement and these Terms and Conditions.
- A preliminary reservation request is submitted to the Lessor via the form available on the website nomadcamper.pl. Upon receipt of the request, the Lessor will inform the Lessee of the availability and possibility of entering into the Agreement.
- A valid reservation requires: (I) signing the Agreement; (II) written acceptance of these Terms and Conditions; (III) payment by the Lessee of a reservation fee amounting to 30% of the total rental price, or the equivalent of a security deposit guaranteeing proper performance of the Agreement by the Lessee. In the event of cancellation, the reservation fee is non-refundable.
- The rental fee is determined on the basis of the Lessor’s current price list available at nomadcamper.pl.
- No later than 7 days before the handover of the Rental Vehicle, the Lessee shall pay the Lessor the full amount, i.e. the security deposit and the rental fee. Failure to pay within the specified deadline entitles the Lessor to refuse handover of the Rental Vehicle and to cancel the reservation. In the event of cancellation, the reservation fee is non-refundable.
- The date of payment is the date on which the funds are credited to the Lessor’s bank account or the date of cash payment.
- The Lessor is entitled to deduct from the security deposit any amounts arising from the Lessee’s improper performance of obligations under the Agreement or these Terms and Conditions, as well as any losses incurred in connection with the Lessee’s use of the Rental Vehicle.
V. Insurance and Lessee Liability
- The Rental Vehicle is covered by third-party liability (OC) and comprehensive (AC) insurance.
- The scope of liability is defined by the General Insurance Terms and Conditions attached as an annex to the Agreement. The Lessee is required to review the General Insurance Terms and Conditions in detail before entering into the Agreement.
- The Lessee is liable for all losses not covered by insurance that arise from causes attributable to the Lessee. The Lessee’s liability for losses is unlimited.
- In the event that the Rental Vehicle is destroyed to such an extent that further use is impossible (including where repair costs would exceed 60% of the value of the Rental Vehicle on the date of the incident), or in the event of loss of possession of the Rental Vehicle (including theft or misappropriation) due to causes attributable to the Lessee, the Lessee shall reimburse the Lessor the amount corresponding to the market value of the Rental Vehicle as of the first day of the month in which the incident occurred (based on the Eurotax system or a similar system chosen by the Lessor). If the incident is covered by insurance, the paid indemnity shall be credited against the amount owed to the Lessor, and the Lessee shall pay the difference.
VI. Lessee Obligations
The Lessee undertakes to:
- use the Rental Vehicle solely in accordance with its intended purpose as defined in the Agreement, these Terms and Conditions, and applicable laws, including traffic regulations,
- operate the Rental Vehicle with due care to maintain proper technical condition,
- maintain the Rental Vehicle in proper technical and aesthetic condition,
- observe the no-smoking policy,
- follow the operating instructions for all technical equipment,
- bear all operating costs of the Rental Vehicle, including but not limited to replacement of bulbs, windscreen washer fluid, tyre repairs, etc.,
- refuel the Rental Vehicle at reputable fuel stations and retain payment receipts in case of engine failure due to faulty fuel. In the event of breach of this obligation, the Lessee bears full liability for any damage to the engine or other components,
- comply with insurance regulations, in particular the General Insurance Terms and Conditions for the Rental Vehicle attached as an annex to the Agreement,
- not make the Rental Vehicle available to third parties not specified in the Agreement. If such a necessity arises, the Lessee shall immediately notify the Lessor,
- not make any alterations or modifications to the Rental Vehicle, nor carry out independent repairs. If repairs become necessary due to a breakdown, the Lessee shall carry them out only after notifying the Lessor and obtaining prior consent,
- return the Rental Vehicle by the agreed date in an undeteriored condition, clean inside and out, under penalty of being charged cleaning costs,
- cover all losses incurred in the Rental Vehicle or its equipment,
- safeguard the Rental Vehicle, its equipment, documents and keys against theft, loss, damage or destruction,
- regularly inspect the Rental Vehicle and verify that it meets all conditions necessary for safe use,
- comply with all instructions of the Lessor regarding proper use of the Rental Vehicle.
The Lessee may not use the Rental Vehicle for the following purposes:
- participation in motor sport events,
- vehicle testing,
- transport of flammable, toxic or hazardous materials,
- aiding in activities contrary to law,
- sub-letting,
- any other purposes beyond the scope of the Agreement, in particular purposes unrelated to driving,
- any other purposes specified in the Agreement.
VII. Liability
- The Lessee is obliged to cover all losses of the Lessor arising from causes attributable to the Lessee or any other person to whom the Lessee has made the Rental Vehicle available.
- The Lessee is liable for all losses caused to third parties in connection with the use of the Rental Vehicle. In this regard, the Lessee also bears full liability for all actions or omissions of persons to whom the Lessee has made the Rental Vehicle available.
- The Lessee is obliged to cover all costs incurred in connection with the use of the Rental Vehicle, in particular fines, penalties and other charges, regardless of the dates on which they are disclosed.
- The Lessor shall not be liable for items transported in or left in the Rental Vehicle.
- Return of the Rental Vehicle to the Lessor does not release the Lessee from liability for damage discovered at a later date.
VIII. Accident Procedure
- The Lessee is obliged to inform the Police and the Lessor of any accident, fire, theft or other damage to the Rental Vehicle.
- In the event of an accident or other incident resulting in damage to the Rental Vehicle, the Lessee is obliged to prepare an accident report. The report must include the names and addresses of all persons involved in the incident and witnesses, as well as registration numbers of vehicles involved.
- The Lessee may not carry out any repairs to the Rental Vehicle without the Lessor’s consent. In the event of any accident, the Lessee should immediately notify the Lessor by phone: +48 666 607 545 to obtain further instructions.
- In cases requiring the Lessor’s consent, the Lessee is obliged to contact the person designated in the Agreement.
IX. Handover and Return of the Rental Vehicle
- The Lessee is required to participate in a training session relating to the use of the Rental Vehicle, which takes place in Szczecinek prior to handover. The Lessor may refuse to hand over the Rental Vehicle if, following the training, the Lessee has not acquired the skills necessary for proper use.
- Handover of the Rental Vehicle is conditional upon the signing of a handover-acceptance protocol by both the Lessee and the Lessor.
- The Lessee is obliged to return the Rental Vehicle by the date specified in the Agreement. Together with the Rental Vehicle, the Lessee is obliged to return the keys and all documents relating to the Rental Vehicle.
- Late return of the Rental Vehicle shall result in a contractual penalty amounting to three times the daily rental rate for each day of delay. The Lessor may seek damages exceeding the amount of the contractual penalty.
- In the event of early return of the Rental Vehicle, the Lessee shall not be entitled to any refund or reduction of the rental fee.
- The Lessor is entitled to demand immediate return of the Rental Vehicle in the event of any damage or breach by the Lessee of the provisions of the Agreement or these Terms and Conditions. In such a case, the Lessee shall return the Rental Vehicle no later than 24 hours from the demand. The demand may be made by e-mail or by telephone.
X. International Travel
The Lessor does not permit use of the Rental Vehicle outside the European Union. Travel within EU member states is permitted without the need for additional consent.
XI. Dispute Resolution
- The Agreement and these Terms and Conditions are governed by the laws of the Republic of Poland.
- Any disputes between the Lessor and the Lessee shall be resolved by the Polish courts having jurisdiction over the Lessor’s registered office (Szczecinek). This applies to all disputes arising directly or indirectly in connection with the Agreement, and this provision shall remain in force even after termination of the Agreement for any reason.
XII. Personal Data
The Lessee consents to the processing of their personal data by the Lessor (e-GOLD LAB, Mateusz Pilecki, Tax ID (NIP): 6731896184) to the extent necessary for the performance of obligations arising from the Agreement and these Terms and Conditions.
